Driver guilty of hitting tot
Cian Bain will never be the same again.
The three-year-old boy has speech and mobility problems and his parents have been told his learning process might always be impeded.
Today in Brampton court,[link widoczny dla zalogowanych], the Mississauga man who struck Cian on a busy Meadowvale street on June 10,[link widoczny dla zalogowanych], 2009 and fled the scene was ordered to pay a $1,[link widoczny dla zalogowanych],500 fine and not drive for 18 months after pleading guilty to his role in the crash.
The boy's injuries were,[link widoczny dla zalogowanych], at one time,[link widoczny dla zalogowanych], considered life-threatening.
"I can't help but think what could have been every time I look at (my son)," said the boy's father,[link widoczny dla zalogowanych], Cecil Bain,[link widoczny dla zalogowanych], in a victim impact statement read into the record by Crown prosecutor Charles Waite. "My son will never be the same and it hurts every day."
Syed Hoda, 50, pleaded guilty today to careless driving and failing to remain at the scene of an accident. Justice Minoo Khoorshed imposed the fine and ordered the man's licence be suspended.
"It would appear Mr. Hoda simply didn't see the boy," Waite said.
Since the crash, well-wishers have been dropping off cards and gifts at the Bains' Glen Erin Dr. townhouse. and wandered out into the street. Donning his dad's sneakers, Cian walked onto Britannia Rd.,[link widoczny dla zalogowanych], where he was struck by Hoda's minivan and thrown 35 metres.
Despite concerns from the man's daughter that he might have hit a small boy, Hoda fled the scene,[link widoczny dla zalogowanych], court heard.
A witness to the crash followed Hoda and forced him to stop,[link widoczny dla zalogowanych]. Auto mechanic Lebert St. Bernard said he saw the boy wandering on Britannia Rd. and made a U-turn to go corral him,[link widoczny dla zalogowanych].
"I didn't get there fast enough," he said repeatedly. "A few more seconds and I would have gotten to that kid."
St. Bernard said the driver who hit the boy stopped for a few seconds,[link widoczny dla zalogowanych], but then drove off.
The mechanic flagged down another driver to stay with the badly-injured boy, then went after the minivan.
He confronted the driver after catching up to him a short time later.
"He said he was in a rush to get home, and I said, 'You can't go home,'" St. Bernard said,[link widoczny dla zalogowanych], adding he insisted the driver remain with him until Peel Regional Police arrived.
Court heard Hoda was taking his daughter to photocopy documents for a class project later that morning. When he struck Cian, he might have been arguing with his daughter after learning she had left some items to be photocopied at home, court heard.
Cian suffered a fractured skull, broken femur, collapsed lung and other injuries. He spent several days at the Hospital for Sick Children,[link widoczny dla zalogowanych], including two days in a morphine-induced coma.
