Attention Kmart shoppers, this is not a blue light special. The New Jersey Division of Consumer Affairs announced on Jan. 11, 2013,[link widoczny dla zalogowanych], a settlement with Kmart in which the retail giant will pay $302,500,[link widoczny dla zalogowanych], donate $25,000 worth of infant formula to charity,[link widoczny dla zalogowanych], pay for continued unannounced state inspections, and implement meaningful remedial measures to inspect its merchandise, after 19 Kmart stores in New Jersey were found to have sold or offered for sale expired infant formula and non-prescription medications.
Kmart has seen better days, once the leader in discount retail stores,[link widoczny dla zalogowanych], is now hanging on by a thread and has tried to make over its image through the years but without success. Kmart and its infamous "blue light special" and its catchphrase "attention Kmart shoppers" were a part of American pop culture and jargon.
Inspections by Division of Consumer Affairs investigators found a total of 257 packages of infant formula and/or non-prescription medications that were from 9 months to 29 months past the expiration date,[link widoczny dla zalogowanych], but still available for purchase on the shelves at the 19 stores. Investigators purchased a total of 68 expired items. The stores are located in Atlantic,[link widoczny dla zalogowanych], Bergen, Burlington,[link widoczny dla zalogowanych], Camden, Cape May,[link widoczny dla zalogowanych], Essex,[link widoczny dla zalogowanych], Gloucester, Mercer,[link widoczny dla zalogowanych], Monmouth, Morris, Ocean, Passaic,[link widoczny dla zalogowanych], and Somerset counties.

Kmart had to agree to several plans to monitor and police themselves and submit a quarterly report back to the Division of Consumer Affairs. Kmart will also provide funding for random, unannounced inspections of its New Jersey stores by the Division of Consumer Affairs,[link widoczny dla zalogowanych], continuing for one year. When patients buy medication,[link widoczny dla zalogowanych], they expect that it has not expired,[link widoczny dla zalogowanych], and will properly address their symptoms without unduly posing a new health risk," Eric T.
